Yeah, it's not illegal to record folk in this country, without their consent. You can record, photograph, film anyone in a public area and I believe even publish it without consent. If it's in the public's interest and you can prove that, you can still publish stuff that shows someone in a bad light. - In someone's own garden, where they may be to expect privacy, then you may have more of a grey area. You can still record/photgraph etc them and not break any laws, it's what happens to the material if you ever need it, like at court. If the worst were ever to happen, like if he attacked you (not that I think he would!) then even in court, if you'd recorded the incident, then lawyers would fight out the use of the material as being in public interest etc can still override the fact that it was recorded without consent. It's down to the situation and the courts on the day. There's no real hard and fast law over this.
You know on reading more about this horrible person ive had a re think ....... what about the video camera someone suggested .
you have no need to actually get one ( though if you needed evidence then it may prove useful .)
But what about following through the suggestion of telling him you have put up a day AND night recording camera ( Sorry don't know the proper name) but I know there are ones which will pick up images in the dark.. and let him know you have it positioned on the whole of your perimeter .the reason being you saw undesirables hanging about ! but I would still have a witness when you tell him .and I would record the conversation just so I could keep a log on him and things he said.
record it on camera ,you can get them quite cheap and if hes as bad as that ,you don't need to confront him he may attack you and as for the dog incident dogs if there trained they don't bite .... oh I feel so sorry for you I thought my neighbours were bad enough ... defo record it and take any evidence to the police good luck
There is also the Barney approach of talking a bit louder than normal into your phone to an imaginary friend when you know he is in the garden .tell your friend how you have had Intruders in your garden so you h a 've got a day and night camera fixed up and trained on the fence circumfrance of your garden. .. if you do this don't forget to tell your friend how the police were very helpful.
This way you might even put the fear of God into him without actually having to speak to him
Thanks for your replies. I was closing the bedroom curtains around 11pm a couple of nights ago and my neighbour was in the garden with a plastic container on his back. Looked as if he was spraying his paving slabs. He was nowhere near the fence at the time. He works for the Highways agency so I'm sure he'll have brought the weedkiller (if that's what it was) home from work. I watched till he'd finished so don't know how close he got to the fence or if he sprayed over the fence before this. Guess a camera would have been handy but haven't been able to go and get one yet. No sign of any damage to my plants yet. Although I've had this garden for 20 years, I've only ever used a weedkiller once on one or two weeds so I'm not really sure how they should be used. I googled it and it seems it's best to use a systemic one when it will be dry for 24 hours so I went out and soaked all along that side of the garden and sprayed down the shrubs and flowers. Just as I finished, the heavens opened and it came down very heavy so hopefully, it's washed any weed killer away.

if hes spraying that time of night something a miss, he either stole it from work or its dangerous and a hazard no one in the right mind would do any sort of gardening so late in the evening ... as I said before I feel so sorry for you and understand the upset my neighbour a bit of a nutter as well... hes got 4 dogs 2 are ok, but the other are a real pain in the neck ive had too replace my fence a number of times as there dogs have broke it.. in fact one of them got into my garden early this year and tried to attack my dogs as ihave cavaliers I caught it on camera and reported it too the police all they did was go around and speak to them I was livid so too speak ... I now have spikes on the top as well as cameras , it not right is it why we have to put up with people like that they should buggle them all up and stick in the same place with electric fencing around them
Annmarie, I think you've got it worse than me if their dogs are causing damage and attacking your dogs. I think that's all the police will do. Unfortunately, that doesn't bother some people. I did think maybe he was doing it late because his 4 year old had been playing in the garden and hadn't long been in bed. I'm sure he will have taken it from work. He's brought home enough wood to fence the whole garden and paving to pave the whole garden in a Highways truck in the middle of the day so obviously during his shift.
Verdun, I'm thinking maybe there won't be any damage now unless he sprays again. I'm keeping an eye on things and watering lots.
