Wrong pants sents from garden nursery

I received supposedly some Phormuim Cream delights from a reputable garden nursery 9 month ago.These we’re planted in my garden. One of the plants hasn’t grown as well as the others so I decided to go to a garden centre and purchase another of these Phormuims.

When I compared the new Phormuim with the ones in my garden there was a different colour in the leaf. I then returned this back to the garden centre and informed them that this Phormuim they sold me did not the seem the same as the one in my garden. 

I showed them a photo of the Phormuim in my garden and they rightly stated that these  Phormuim were propably not cream delight and I’d been supplied with the wrong plant from the nursery
i’ve since contacted the nursery who supplied the plants and they have stated that as it’s been 9 months since they supplied the plants and since they had been planted in my garden they have no responsibility to correct their mistake
I’d paid out over £140 for these 6 plants to be supplied and delivered. At present I have no idea what Phormuim plant I have in my garden. What size it will eventually grow 

I selected Phormuim cream delight because it’s one of the smaller  sized Phormuims that would suit my new modern garden design
If any one can please confirm if I have any legal rights or not to request a full refund for them supplying the wrong plants

    you could start by showing us the plants. Somebody probably knows them well. (Not me) at the moment you have no real proof of wrong plant, it may be the garden centre that's wrong. Nurseries are more likely to be right in my experience

    Have you read the small print, terms and conditions? There is usually a time limit and after that is passed the nursery is no longer obliged to change the plants.

    I grow C. Delight so if you can show us a pic, that will definitely help @Stevedaylilly, as it could well be you have the wrong plant, and could get a refund or something.
    They often get a bit manky at this time of year though - rusty looking from an insect that damages them, but they recover from a cutting back. I was lucky mine survived last winter's large swing in temps, which saw off all the others I had, so it's still very small, ,having been a well established specimen.
    I can find an old photo if that would help though.  :)
    It's a place where beautiful isn't enough of a word....

    Below Phormuim Cream delight from local garden centre 

    Phormuim presently in my boarder and not Phormuim Cream Delight. So in my opinion the nursery sent me the wrong plants costing £140 with delivery

    Add to that I will need to remove all 6 plants as I haven’t got a clue what’s presently in my border. It’s is going to be too large in size when fully grown. 
    Bur it seems the nursery have nil responsibility to put this right
