That was my other worry too. It does feel like catch 22 but I think you are all correct especially re: interest of police. I don’t think they would be interested in the criminal damage aspect or knowingly destroying a bird nest.

In my experience the police are loathed to get involved. We had issues with a previous neighbour who damaged the drive between our houses, cut back bushes which belonged to us and made claims that we were harassing her when we tried to get her to pay for the damage. The police weren't interested as seemed to them a case of he said, she said. She made our lives hell by playing loud music, light smoky fires in the garden, staring at me when i was in the garden, trying to intimidate us and generally being totally unpleasant. We made the decision to move and it was the best thing ever we did. Oh and on the day we moved out she play the song celebrate good times so loud we could hear it our house with our door shut!

I know it's probably not what you want to hear but life is too short to put up and fight with people like that

It makes me seethe with loathing & hatred for 'neighbours' like that ; what right have they got to destroy other peoples lives ?
Ten - years ago we had the ultimate neighbours from hell ; trespass , all night parties indoors and out , deliberate vandalism , banging on walls etc. drugs as well ; they purposely aimed fireworks into my garden and threatened my son of 13 with GBH.
This went on for a time through no fault of our own ; I eventually broke the law myself and took matters into my own hands ; I returned like for like amplified to a higher degree . Obviously I cannot go into too many details on a forum like this , but needless to say , THEY were the ones who moved out , not us .
Now I can enjoy peace and quiet in my own garden once more . Havn't seen them since .
I know this doesn't help poor Mark56 at all , and I sincerely hope his issue can be resolved .
PS At the time the police , environment and council etc didn't want to know ; I had no other options .

What kind of screwed up world do we live in where the noisy, abusive neighbors get away with it whilst the victims have to move?! Nearly a decade ago the council wouldn't help me move (I was considered the lowest band), despite giving them proof I had been burgled multiple times and was living an increasingly stressful life due to neighbors which I wont go into detail. I only got out quickly thanks to grandparents paying a deposit. Honestly, if I won the lottery I'd be inclined to help those who've been in a similar situation to mine.

Bottom line, don't rely on the council. They are unsympathetic bleeders who couldn't give much of a crap. I hope you get the situation sorted regardless! Bets of luck :)

Agree entirely with your views ; don't rely on anyone but yourself ! The way this country is going it will probably be a situation of having to take the law into your own hands(so to speak )!

I don't think it's a police matter -it's a civil offence rather than a criminal one; and involving the police won't look good if you do decide to sell one day. This doesn't mean you can't threaten police or court action, in the hope of scaring them. Maybe CAB can advise you?

We went to CAB ten years ago regarding our 'neighbours' ; advised to contact local council :- nothing transpired and no help whatsoever !
During one of the worst scenarios , our local 'constable' sat at night having a drink with them !!
Police or court action doesn't frighten scum like that ; they're normally used to it anyway . My wife had just had a major operation and was confined to ground floor , having to sleep in the front room and subject to incredible (nightclub volume) music @3.00am !
At the time I think if I'd had access to firearms I'd have taken them all 'out' !
Fortunately I had contacts who made life very 'difficult' for them , and would you believe it , they exited fairly rapidly leaving a heap of unpaid bills and court summonses on their doorstep .
Oh well , and to quote a modern parlance ; "See you later"!!!!

How awful for you Mark.  I would sell up and hope to find a buyer as obnoxious as the neighbours.
  • They can't touch the hedge your side, only the overhanging branches their side and they have to give you back the cuttings, if they have come and cut your side, its called as criminal damage and trespassing .I only know this because I have had the same issue with our neighbours.

We had 'issues' with immediate neighbours at our previous property or - more correctly - with their sons. They parked all over the shared drive and were often left alone to party to their hearts' content while mummy and daddy stayed at the flat over their business. M&D always apologised when we complained but didn't do anything to stop them.

Despite being very good friends with all the other neighbours we decided to move because it was all too stressful. We are much happier in our new home.

    But.... revenge is sweet.

We sold to a (nice!) young couple with a toddler and another on the way. The childrens' rooms would have been next to the troublesome boys bedrooms (semi-detached properties). So I hope they've enjoyed the baby screaming in the early hours and I hope there's been a lot of jumping on the beds. The infants will grow up to be teenagers too...

A load of houses are also being built at the back of them - looking directly into the neighbours' house and garden & ruining their view over the fields.

    Karma!
Heaven is ... sitting in the garden with a G&T and a cat while watching the sun go down
