    Technically yes. Just guidance though really and open to interpretation. For example I don't usually see a Sparrowhawk actually land when one catches a bird in our garden. It just grabs and carries on flying. Personally I'd count the Sparrowhawk even if it just flew through and caught nothing. For that matter I'd count the Kite as well.

    @LunarSea. I would definitely count that. It wasn't just flying over it actually came into your garden to grab something although it's feet may not have touched the ground. 
  • We struck lucky this year as a kestrel landed in one of the trees by the pond and stayed there for over 15 minutes, watching the goings on of the smaller birds. They seemed unbothered by its presence.
    We eventually got most of the expected species, but real numbers weren't well reflected.
