OK. A pic to show the fruits might have helped with id.
Small fruits...try to cut one in half...round the equator.
If it has a stone in the centre it will be a plum, cherry, sloe ...Prunus sp.
Might it be a cherry plum..Prunus cerasifera?

Whatever species this tree is, if the fence we see on the left of the photo is the border with the neighbour, then the tree is far too close to it! To avoid future problems I strongly advise uprooting the tree.
