Possible dispute over neighbours new drive

Hi im new to this

Basically our driveways run in between our bungalows side by side separated by a fence with stone underneath to drain away the rainwater.

My Neighbour is having Indian stone laid which looks really nice,but they are laying it more or less flush with the fence without leaving a gap for stones to drain away any water they have laid a drain from her bungalow to the fence,but my concern is any rainwater will run down the drain under the fence and onto my stones onto my side.

The problem is underneath the stones is clay which obviously doesn't drain very good.so if we have really bad rainfall all the water will be coming towards my side and possibly flooding my drive.

Hope this makes sense.

    Your neighbour is probably trusting the contractor to do the job properly.  If you have any concerns you certainly need to raise them now rather than risking a dispute later.

    As a lawyer and a gardener I fully endorse the opinima above. Talk to your neighbour. You raise a reasonable concern, discussed reasonably there should be a reasonable solution. Do try to avoid adding anger/drama or emotion to your concerns. These things escalate horribly and are not only ludicrously expensive to resolve in the courts, they are challenging personally. Do all you can to resolve it calmly between the two parties. If all else fails, choose mediation over legal action. Good luck.
