Thank you all so much for your advice & ideas. This fence is NE facing, both my neighbour and I put in objections to the local authority about the height of the fence to no avail. We even had the planning officer who was covering the build visit, and he agreed the fence was to high, however the property owner just build his ground up on his side to reach the 2mtr limit. Because the ground slops down towards my property, on my my side the fence height is 2.8mtrs, its like the Berlin wall !! I feel very let down by the local council & have lost all faith in them looking after the residence interests.
The builder has planted sympathetic trees on his side to create privacy as that is as important to him as it is to us, he also said we could take our existing fences down gaining 18" into our small gardens. I didn't have a lot of choice but to do this as the new fence was erected leaving old raspberry canes in the gap which then invaded my garden, the only way I could get to the roots was to take my fence down (it was old anyway). The fence owner has said he is happy for us to grow against the fence but we must be aware that when the fence needs replacing the 18" of land is his and he will gain access to it to do repairs. Perhaps I should just put up another fence on my boundary and not worry about the 18" gain ????
Stick another fence up Angie. It'll save you any grief. The 'fence owning' neighbour sounds like an a***hole.
Oh - and plant as much Berberis and Pyracantha on it as you can. He'll enjoy that when he has to squeeze into the 18 inch gap to do his repairs.....

I think I may just put up another fence or a sturdy trellis work, your right it will save a lot of grief, and I look forward to watching that neighbour repairing his fence.....

Yes, I'd do that to save problems in the future, you don't want him destroying all your efforts now. Pyracantha would be a brilliant thing to put up it anyway, but other possibles are Clematis armandii, or a climbing rose--you don't say how shady it is? 'New Dawn' or 'Madame Alfred Carriere' might be nice.
