Fence Dispute

After a bit of advice please. Our neighbour has attached fence panels to our existing fence, the panels they have erected are a foot higher than ours. They have used our fence and our posts for support. On top of their fence they have put trellis on top of their panels and fairy lights on top of that. They also have plants growing up their trellis. This has weakened our fence and is now unstable. As a result our fence panels now need to be replaced, as it is not a shared boundary this will be at our expense. Where do I stand legally here? Are they allowed to attach things using our fence and posts as a support for theirs? Any help would be very much appreciated, thank you.

    Short answer is no Gill, they can't attach anything to your fence.  

    This sort of situation can be tricky though. Can you prove the boundary is yours and definitely not shared? If you're sure it's not a shared boundary, then they can't use it - the fence is yours. Can you check your deeds or contact a solicitor to clarify it? 

    Even so, it can cause problems as they might object if you say to them they'll have to remove what they've attached. Again, some legal advice may help if you don't want a confrontation. Very awkward for you  image

  • When you bought your house the solicitor normally obtains the house registry details which show which are your boundary fences. If the fences are yours then the neighbour should not do anything to them without your permission as far as i am aware. Good luck image

    If you stand in your  garden at the rear of your house the fence on the right is your responsibility if you own your house. The left hand side is your neighbours responsibility...

    Fencing is a pain, I tend to negotiate with the guy on my left as he is very eldery and we shared the cost of replacement last time..

    If I had someone use my fence and attach another to it, I would definately say something first and if it was not resolved amicably then a solicitor would be dealing with this for me...
