Fruit tree with non invasive roots

Hi, 

I have a small garden (4.5 x 10m) and the surveyor told us we shouldn't plant big trees because of the nature of the soil on which the house / garden is built. I would love to have a fruit tree in the garden but need advice either on which trees has the least invasive rooting system or which fruit tree you can have in a big pot.
