Does the guttering of the neighbours garage drain on to your land? Is there a drain there or is it a soakaway? The way the fence has been put in implies the next door neighbours garage is right up to the boundary with the gutter hanging over.
The guttering of his garage does indeed drain onto my land, but into a drain. Why?
To be honest, neither myself nor my neighbour are bothered about the position of the fence, just the colour and the fact it is nowhere near a match to the existing fence.
Yes it is a few inches high, which annoys me too, but that's a minor problem compared to the colour!!
I think we should kill one myth now: there is a convention that you put the posts of your fence on your side of it (in other words, out of goodwill, you show the neighbour the 'best' side) but this is only a convention and doesn't denote legal ownership and responsibility for the fence. The only way to find out ownership of the fence is to look at the property deeds or, failing that, further investigation by a solicitor.

I think they've used old weathered wood myself.
