Waxflower tree/shrub (is it dead??)

Hello,
we’ve had this Waxflower tree for about 3 years. I’m pretty sure it’s gone brown and come back every year (but really can’t say this with 💯 certainty).
one picture is it alive, the other one it is now. Just feels like it should’ve gone green by now.
ant help would be great

If so, it doesn't seem to be very hardy. Are you in the UK or somewhere else?
I live in west central Scotland - not where that photo is...
