New Amelanchier Delivered with Rust Spots

In April I bought and reserved an Amelanchier Robin Hill at my local nursery. They held it for me as my garden was being landscaped and not yet ready for planting. Today it was delivered and my beautiful tree is covered all over in rust spots. What can I do?

    @ellalaine Welcome. I would go back to where you bought it from. Ask them for their advice on exactly what is wrong with it, even if you have a good idea yourself. I am sure it was an expensive purchase and you need to know if it might be something that will return each year. Plants and trees are growing under considerable stress at the moment and it may have suffered due to the dry winter and spring.
    I don't know your consumer rights but someone here will be able to help.
    I have worked as a Gardener for 24 years. My latest garden is a new build garden on heavy clay.

    You bought a healthy plant and they delivered a diseased plant.
    The nursery should be more than willing to refund or replace.
    The Consumer Rights Act 2015 is very supportive. 

    Are you sure it's rust?
    We may be able to confirm if you can post a pic or two.

    I agree it does look like rust and you should ask for a replacement or refund.

    Have spoken to Nursery and they have said they will check their stock and find a replacement for me. He said something about checking to see if the whole batch was being treated for rust but they seem very willing to replace it and apologized. Bit weird that they didn't notice when they delivered it. It looks like a dalmatian!!
