Why do you need to remove the hedge rather than cutting it back @Beartricks ? Is the space too small for both?
If you're able to put the tree 8 metres from the house, you can probably have both, and plant the tree nearer the house instead. I'd say an apple is probably the best bet too.
I certainly wouldn't plant it right next to the pavement, for the reasons given earlier. You'll also get kids swinging on the branches, and damaging your tree, if they're anything like the little toerags we get here. You may also have problems with pedestrians objecting to any lower branches they need to negotiate, so that could end up being a problem. The hedge would help mitigate that too.
