    There looks to be a Tree Fern there and they are not hardy and I would not have planted one in November.
    The Black Bamboo should have been all right, although it looks very sick, and again November is not a good planting time.

    It seems you wanted a Mediterranean style garden, do you have Mediterranean type conditions and weather? 
    I wouldn’t expect them to flourish up there on clay. 
    Shame on the Landscaper.
