Having had 2 lime trees in my front garden under TPO it is fairly simple to override and where the council own the trees they seem to cut down perfectly healthy ones if they are in the way.
The a whole section of the A6 in Darley Dale is lined with these 100 year old trees and they look amazing in summer but they are the most unpleasant tree to have in your garden as everything turns sticky and black due to the secretions from aphids so I am not surprised he wants them gone.
Every one has the right to build to their boundary and hopefully he had to under pin your wall with concrete when the foundations were dug. He also has the right to cut back branches and roots on his property.
One of our trees I managed to get cut down as it was diseased and I was very concerned about it causing an accident if a branch fell into the road. The council weren't happy but like Janie B but were not willing to shoulder the liability . I did have to replace with another lime tree though.
I wouldnt hold out much hope on Council support though you can use your house insurance or car insurance legal cover to phone for advice.
To my mind he has to prove damage but I don't think ignoring the issue is the best way as you will find it very stressful.can you post a photo of the trees in relation to his garage.
