i have some in a pot and some in the ground grown from seeds. Do they need staking? Should I pinch out the tips?

The term "marigolds" is used for lots of different plants. Which do you have?

It’s as tall as my tomato plant so about 2 ft? And you can see the flowers here too. No other details as the seeds were collected and given to me.

They look like french marigolds. Just pinch off the dead flowers  to keep them flowering.

If you want a bushier plant, yes you can cut the tops off. Can't answer whether they need staking, I wouldn't bother personally. They'd be less likely to flop over if you topped them.

Thanks, I’ve pinched out a couple but most are showing flower heads now so have left them
