Fence height causing privacy issues

  • Trellis is excluded from fence height - I’ve already spoken to the council so I’m not worried about that. I’d welcome the council review though as the raising of the garden is by 45cm and planning regs say 30cm Max or permission needed. As there’s no retaining wall or drainage they’d be tasked with returning the garden to the original level. The transfer deeds also say you can’t change the level of the land so that may prevent the site being adopted. You have 5 years to place a legal challenge or the change in level becomes accepted. 
  • So the bad news is Council say you can raise the level of your land and do not need planning permission.  They advised me to take legal action against the neighbour for not installing a retaining wall as this will cause the fence to rot prematurely and it's in our house deeds that you cannot alter the levels of the ground or raise the height of the fences. So, now i've got to wait for it to rot and for their garden to fall into mine so that they will have to resolve it. It's decking that you can't install above 30cm. Now all I've got to do then is resolve the nosey neighbour with plenty of screening. Am hoping the photinias will take off with a growth spurt next year.

    Those take a lot of time, a lot of care, and a lot of maintenance to get them looking like that   :)

  • That's not a problem. I have the time, patience and persistence to get them there.

    old thread trawled up by a spammer. If there were going to be hot tubs I expect they’ve arrived by now. 
    It always pays to check the dates of earlier posts on a thread.
