Neighbours plants damaging my Mum's fence

  • I'd suggest not cutting neighbours' shrubs down, except the bits that come across the boundary line, because that's criminal damage. You would therefore be having to defend the indefensible, instead of holding the moral and legal high ground.

  • If solicitors get involved the first thing they will do is get copies of both title registers.  It's the first step as titles and plans and any deeds and grants within can contain a wealth of information or nothing at all.  But its a process they will charge an absolute fortune for.  It will cost them less than the £6 you'll pay if you do it yourself and they'll charge an hours fee typically £200+

    You may be planning on repairing / replacing a fence / boundary structure that you have no right to.  It's worth spending £6 to find out.  Titles and there plans can give a lot more info other than where any boundary may be it can also say who is responsible for the upkeep and maintenance of the boundaries regardless of where the boundary is or whether it's in the correct place or not.

    It can be several feet or more out from where it says it is on the title plan but if the title says that one of you is responsible for it then that person is responsible even if its not where it should be.

    My home is a mid terrace and my title register (and everybody else's) in our row say that we all responsible for the boundary structures upkeep and maintenance to the left.   The property to the extreme right is responsible for two boundary structures, everybody else just one to the left. 

    It says so within our titles.   This thread isn't about where the boundary is or if it's in right or wrong place, it's about getting it repaired or replaced and the titles may answer this question.  In addition the OP is assuming the neighbour owns the property next door when they may be tenants which means she's talking to the wrong person to try and get the fence sorted.  The neighbour may not own the property, the title will clarify this one way or the other.

    I think her neighbour as got a cheek telling your mother to pay for your neighbours job, some people have got some neck on them!! ggggggrrrrrr image, hope you get the issue sorted very soon ?
