That could work well ... first thing to do is clear the area and sort the fence out, if it's yours, making sure it's sturdy and won't need work later on that'll affect the rest of the area, then decide what sort of hard surface you want.
Okay, things have developed a bit and I’ve gone off the Italian idea due to the cost of trees and now I’m thinking herb garden. I need it a bit wild for the frog living in there, so maybe ship in some dandelions, old daffs and sweet pea on the arch,

Quite a lot of work there, but could be a very nice spot to sit in. Most herbs require full sun though so that may not work. It looks like you have some bluebells coming up in the corner (probably Spanish ones) which would suggest a woodland feel to me. I would take out the tree, remove/hide/tidy up the leaf pile and think about what kind of surface you want i.e. grass, paving or gravel. When you've got the basics sorted out, then you can start thinking about any planting.
The tree I’m not so sure about removing yet, but I guess I do need to make a decision.

Im tempted to just do the borders, mow over, fill gaps with spare turf until later in the year.
I want to focus on getting stuff growing in there now. In previous years lettuces and wild flower have boomed there, but I have added shade with the weave fence.
Boy, two and a half years went quickly and I still havent developed it!
Only now Ive decided that whole back section of the garden is to revitalised as a BBQ/Pizza and Play area.
1. Ive got a very successful grapevine I want to attach to a pergola.
2. Im thinking the tree would do better with the grass removed under the canopy and a gravel or woodchip surface.
3. The path is straight/right angled. Im not sure I want the effort if lifting it, hut Insuspect a circukar design would be better and contrast with the formal lines of the rest of the garden.
